1. Introduction

Welcome to JCarlston.com, owned and operated by Dr. John W. Carlston, DCPC, an S-Corp registered in the State of Kansas. These Terms of Service (“Terms”) govern your use of our website, programs, wellness retreats, expert summits, personalized treatments, and all related services (“Services”).

By using our website, booking services, or participating in any program, you agree to these Terms.

If you do not agree, do not use our website or Services.

You must be:

18 years or older, or

These Terms apply to services delivered in Kansas and outside Kansas, both online and in person.

2. Definitions

Refers to Dr. John W. Carlston, DCPC, the S-Corp entity, including its employees, contractors, representatives, or affiliates.

2.2 “Client” or “You”

Any individual who uses the website, books services, or participates in any program.

2.3 “Personalized Treatment”

1:1 individualized wellness sessions delivered online, in-office, on-site, or at hotel locations. These may include functional assessments, soft tissue therapy, kinesiology, movement-based evaluations, lifestyle and nutritional suggestions, and non-diagnostic support.

2.4 “Wellness Retreats”

1:1 immersive wellness programs delivered across multiple days in four formats: face-to-face, on-site, in-office, or at a hotel location.

2.5 “Expert Summits”

Educational or experiential programs including instruction, presentations, tools, wellness content, or coaching.

2.6 “On-Site Services”

Any service delivered at your home, business, hotel room, or other location selected by you.

2.7 “Company Representatives”

Any person assisting, supporting, or providing services under the direction of the Company, including contractors.

2.8 “Third-Party Tools”

Platforms and technologies used to deliver Services, including but not limited to: GoHighLevel, Zapier, Stripe, Calendly, Zoom, PayPal, Dropbox, Google Workspace, MailChimp, Notion, and others.

2.9 “Non-Medical Services”

All services that do not diagnose, prescribe, treat disease, or replace medical care.

3. Scope of Services

Our Services blend several roles:

◉ Non-licensed chiropractic-style techniques

◉ Functional assessments (non-diagnostic)

◉ Soft tissue therapy

◉ Applied kinesiology

◉ Muscle testing

◉ Nutritional and lifestyle suggestions

◉ Health coaching, life coaching, wellness coaching

◉ Performance optimization

◉ Retreats and educational programs

We do not diagnose or treat medical conditions.

We do not prescribe medications.

Our Services do not replace medical care or emergency care.

4. Health & Wellness Advisory

You acknowledge and agree:

◉ Services are collaborative wellness support, not medical treatment.

We do not provide medical diagnoses; instead, our services focus on non-diagnostic functional assessments and wellness-based insights that do not identify or classify diseases.

◉ No statements made during sessions should be interpreted as medical claims.

◉ You are responsible for seeking medical care when necessary.

If you experience new or worsening symptoms, consult a licensed healthcare provider.

5. Service Delivery Types

Your Services may be delivered:

5.1 Personalized Treatment (1:1)

◉ Online video

◉ In office

◉ On site (home or business)

◉ At hotel or remote location

5.2 Wellness Retreats (1:1)

Delivered in the same four formats, may include travel, equipment transport, and multi-day support.

5.3 Expert Summits

Educational, coaching, or performance-based events with no guaranteed outcomes.

6. Client Responsibilities

You agree to:

◉ Provide accurate, truthful health information

◉ Maintain a safe environment for on-site or hotel-based services

◉ Avoid hazardous or inappropriate environments

◉ Follow instructions and safety guidelines

◉ Not record sessions without consent

◉ Acknowledge natural physical and emotional risks

◉ Understand that results vary

7. Payments

We accept:

◉ Credit cards, debit cards

◉ ACH transfers

◉ Checks

◉ PayPal

◉ Stripe

◉ Wire transfers


7.1 Payment Timing

Personalized Treatment: payment due on or before the date of service

Wellness Retreats: payment due before scheduling or participation

Expert Summits: payment due before scheduling or participation

Payment plans may be offered at our discretion.

8. Refund & Cancellation Policy

8.1 Personalized Treatment

Online Video:

◉ 100% forfeited if canceled within 24 hours

In-Office:

◉ 100% forfeited if canceled within 24 hours

On Site (home/business):

◉ 100% forfeited if canceled within 2 weeks

Hotel or Client Residence:

◉ 100% forfeited if canceled within 24 hours

8.2 Wellness Retreats

◉ 100% forfeited 3 days after purchase

8.3 Expert Summits

◉ 100% forfeited 3 days after purchase

8.4 Rescheduling

◉ Allowed when notice thresholds are met.

9. No Guarantees

We do not guarantee:

◉ Pain reduction

◉ Physical performance outcomes

◉ Emotional or mental changes

◉ Health improvements

◉ Nutritional or metabolic outcomes

◉ Business outcomes from summits

◉ Any specific result

◉ Results vary widely based on individual differences.

10. Assumption of Risk

You understand that wellness, movement, and hands-on approaches involve risks, including but not limited to:

◉ Physical strain

◉ Emotional discomfort

◉ Reactions to movement or touch

◉ Environmental hazards in on-site settings

You assume all risks voluntarily.

11. Testimonials & Marketing Consent

If you provide a testimonial voluntarily:

◉ You grant us permission to use it in marketing

◉ You may request removal at any time

◉ No guarantee that outcomes will match those of testimonial providers

We do not use client stories without consent.

12. Digital Products & Content Use

Any content provided to you, including:

◉ PDFs

◉ Worksheets

◉ Videos

◉ Online modules

◉ Summaries

◉ Slide decks

◉ Audio files

◉ Proprietary methods

Is licensed for your personal use only.

You agree not to:

◉ Copy

◉ Record

◉ Sell

◉ Distribute

◉ Share

◉ Reverse engineer

◉ Upload publicly

13. Third-Party Tools

We use third-party providers for:

◉ Payments

◉ Communications

◉ Data management

◉ File delivery

We are not responsible for outages, delays, data loss, or security issues caused by third-party platforms.

Use of our Services constitutes acceptance of those platforms’ terms.

14. Travel Policy

For on-site or hotel-based services:

◉ Client provides safe, clean, accessible environment

◉ Additional fees may apply (travel time, mileage, equipment transport, lodging)

◉ The Company may refuse unsafe locations

◉ Travel interruptions may require rescheduling

15. Confidentiality

We respect client privacy.

Although we are not bound by HIPAA, we:

◉ Keep session content private

◉ Do not disclose client information without consent, except where required by law

16. Communications Policy

We respond as soon as reasonably possible, depending on schedule and travel.

We do not provide:

◉ Emergency care

◉ Crisis support

◉ Urgent medical response

If you need urgent care, call 911.

All official emails come from [email protected].

17. Limitation of Liability

Our total liability is capped at the total amount paid for Services in the last 30 days.

We are not liable for:

◉ Indirect or consequential damages

◉ Lost profits

◉ Personal injury caused by unsafe environments

◉ Actions or omissions by third-party platforms

◉ Misuse of recommendations or content

18. Indemnification (Expanded)

You agree to indemnify, defend, and hold harmless the Company and its representatives from any claim arising out of:

We will reschedule when possible.

21. Entire Agreement
